Montana Utility 811 Dig Rules
December 01, 2021
--Montana 811 ORG
Please be aware, as required by Montana Law MCA 69-4-5, anyone who excavates must notify the one-call notification center to have underground facilities marked prior to excavation. MCA 69-4-501(12)(a) defines "Excavation" as any operation in which earth, rock, or other material in the ground is moved, removed, or otherwise displaced by means or use of any tools, equipment or explosives. The term includes but is not limited to grading, trenching, digging, ditching, drilling, augering, tunneling, scraping, and cable or pipe plowing and driving.
MCA 59-4-503 gives underground facility owners 2 FULL business days to complete their locate markings. You must wait until ALL underground lines are located and marked or until you have been notified that they are clear of the area of excavation before beginning work.
MCA,59-4-5 also states that if you damage an underground facility because you did not follow the requirements, you could face a civil penalty as well as be responsible for any damages.
If you have any questions on this or any other "one-call" issues or to obtain a full copy of the Montana "Dig Law" please visit www.Montana811.org, or email me at clint.kalfell@montana811.org, or give me a call at 406-442-3070.
PLEASE REMEMBER BE SAFE AND CALL 811 EVERYTIME YOU DIG TO GET UTILITIES MARKED, EVEN IF YOU THINK YOU ALREADY KNOW WHERE EVERYTHING IS!
